- Description: PPWR Article 45 has applied since 12 August 2026. One authorised representative per member state, no single window. The full cost stack per country, and the break-even point.

**Short answer.** The PPWR generally applies from 12 August 2026\. Article 45 contains country-specific EPR representation rules, but the answer depends on your producer status, establishment and supply route. Confirm those first, then obtain a quotation for each destination where representation is required. A recurring per-market charge can materially change the economics of a small market.

*Checked on 9 September 2026\. Reference links and verification limits are listed under Sources at the end.*

Most guidance on the packaging regulation is written for manufacturers. The companies feeling it first are smaller sellers who never thought of themselves as producers at all, and who now carry a per-country obligation that has nothing to do with how much they ship.

## Key takeaways

- **Article 45, not 40 or 42.** Several published guides cite the wrong article.
- **One representative per member state.** Three destinations can mean three country-specific mandates; confirm the applicable producer role first.
- **Fixed cost, variable revenue.** A provider retainer may remain payable even when revenue falls.
- **Micro-enterprises are not exempt from EPR.** Other exemptions exist, this one does not.
- **Registration is often free.** What registration obliges you to hold is not.

## What actually changed on 12 August

Regulation (EU) 2025/40 was published in the Official Journal on 22 January 2025, entered into force on 11 February 2025, and became generally applicable on 12 August 2026 after an eighteen-month transition. It is directly applicable EU legislation. Individual provisions have different start dates, and national registers, schemes and enforcement arrangements still need to be checked.

That matters for anyone who has managed packaging compliance market by market. There is a common framework, but not one universal deadline for every requirement.

01 / Application timeline

A planning overview, not an exhaustive applicability check. Open a row below for the question to resolve.

PPWR obligations by application date. Green Insider, September 2026.

What should I check for 2026?

Confirm your operator role, packaging type and the precise provision. The general application date does not mean every later design or labelling measure began then.

What should I check for 2030 and later?

Check implementing and delegated acts, exemptions and the relevant packaging category. “2030” is not a universal start date for every reuse, refill or recyclability duty.

One detail catches people out on the chemistry side. Where total fluorine exceeds 50 mg/kg, the manufacturer or importer must be able to demonstrate on request whether that fluorine is PFAS or non-PFAS in origin, which means requesting test data from packaging suppliers rather than assuming it.

## Two representatives with similar names

The regulation contains two different roles that are routinely conflated, and getting them the wrong way round produces either unnecessary spending or a genuine gap.

The **product conformity representative** under Article 17 is optional. One mandate covers the whole EU, and the role concerns the technical file, the Declaration of Conformity and market surveillance requests. Note that drawing up the technical documentation itself stays with the manufacturer and cannot be delegated into this mandate.

The **EPR authorised representative** under Article 45 addresses a different obligation and is appointed for the relevant member state. Check the producer definition in Article 3(1)(15), the appointment conditions in Article 45(3), and the national rules for your supply route. Article 44 concerns registration; Article 43 concerns packaging-waste prevention.

Article 45 is also worth naming precisely because several widely circulated guides attribute the obligation to Article 40 or Article 42\. Those articles cover other ground.

---

## Who counts as the producer

The producer definition in Article 3(1)(15) distinguishes packaging types, establishment and supply routes. The responsible producer is not necessarily the packaging manufacturer. Map the actual seller, importer and destination before assuming a supplier has covered the obligation.

Do not assume that micro-enterprise status gives a blanket EPR exemption. Some manufacturer and supplier provisions have specific conditions; they do not establish a general transfer of every small seller’s documentation duties. Confirm the relevant role and exemption for the actual packaging and supply chain.

Enforcement arrives commercially rather than by letter. Qualifying online marketplaces must verify that traders selling into a member state hold a valid producer registration there, so a missing registration number can stop sales before any authority takes an interest.

## The cost stack, per country, per year

Germany’s ZSVR confirms that LUCID registration is free. Registration charges elsewhere must be checked with the relevant authority. Representation, scheme participation and reporting can create separate costs even where registration itself is free.

02 / Build your annual cost

Editable example for one market. Blank or negative inputs are rejected; zero excludes a cost from the model.

| Cost line / basis | Annual budget (€) | Before using this figure |
| ------------------------------------------------------ | ------------------------------------------------------------------------------------------------- | ------------------------ |
| National register entryFixed / country-specific | Confirm the authority’s charge. LUCID registration is free. | |
| Authorised representativeRetainer / quotation | Illustrative €600 assumption, not a sourced quotation. Check country, scope, VAT and renewal. | |
| Scheme membership and eco-contributionFixed + variable | Enter the annual budget; obtain the material, weight and minimum-fee schedule. | |
| Reporting and record keepingTime or retainer | Include internal time at your own rate. Exclude services already bundled above. | |
| Separate national taxesActivity-dependent | Enter only applicable costs not already deducted in your margin. Zero means excluded, not exempt. | |
| Entered annual total / market | €600 | |

Separate recurring retainers from charges that depend on packaging material, weight or activity. Reporting and scheme contracts may combine fixed and variable elements. The values below are planning assumptions, not a verified market-price survey; replace them with written quotations and avoid counting bundled services twice.

Check thresholds separately for registration, reporting and payment in each country. A fee threshold should not be treated as proof that all other duties disappear.

## The break-even question nobody publishes

Once the fixed layer is known, the decision stops being about compliance and becomes arithmetic. The question is how much revenue a country must generate before it pays for the right to sell there.

03 / Revenue needed to cover the cost

Contribution margin before entered costs (%)Number of identical markets

Use a margin before the costs in table 2; deducting them twice would overstate required revenue. Use a separate calculation when countries differ.

| Annual cost / market | 10% | 20% | 30% | Your margin |
| -------------------- | ------- | ------- | ------ | ----------- |
| €200 | €2,000 | €1,000 | €667 | €1,000 |
| €600 | €6,000 | €3,000 | €2,000 | €3,000 |
| €1,200 | €12,000 | €6,000 | €4,000 | €6,000 |
| €2,000 | €20,000 | €10,000 | €6,667 | €10,000 |

Your example: €3,000 revenue per market · €9,000 across 3 markets.

Figures change with your inputs. They do not update automatically when law or provider pricing changes.

Run your own numbers per destination and the marginal markets identify themselves. Use your own contribution margin and costs to identify which markets cover their additional compliance burden.

The calculator compares trading economics; it does not price the risk of non-compliance or authorise sales without the required registrations and mandates.

## Method note

The tables distinguish a regulatory planning overview from an illustrative commercial model. The original draft did not include the four pricing sources behind its quoted ranges, so those ranges are not presented here as verified provider prices. No live price feed is connected.

Break-even revenue equals entered annual compliance costs divided by the contribution margin before those costs. The model assumes identical markets and a constant margin; it does not include taxes or fees omitted from the inputs. Positive costs cannot be recovered at a zero contribution margin. Revenue outputs are rounded up to whole euros.

COM(2025) 982 is a proposal concerning suspension of appointment requirements, not evidence by itself that a suspension is in force. Verify the adopted text and applicable national arrangements before relying on relief. This edition does not certify the current legislative outcome.

## What to do this month

1. List every member state where your packaging reaches an end user for the first time.
2. Confirm whether you are the producer in each one, or whether an established supplier or importer holds that role.
3. Request written quotations for representation in each country, per category, before assuming the market is affordable.
4. Pull packaging weight by material from your actual catalogue rather than an estimate.
5. Check whether a separate national packaging tax applies on top of your scheme fee.
6. Run the break-even table for each country using its own costs and margin before deciding whether to continue, change pricing or exit.

## Frequently asked questions

### Do I need one authorised representative or one per country?

Where representation is required, the mandate concerns the relevant member state. Confirm your producer status and supply route before assuming every destination automatically requires the same appointment.

### My company is a micro-enterprise. Am I exempt?

Micro-enterprise status is not a blanket exemption from EPR. Check the specific manufacturer, supplier and producer provisions that apply to your packaging and supply route.

### Is this the same representative as the one for product conformity?

No. The conformity representative under Article 17 is optional and one mandate covers the whole EU. The EPR representative under Article 45 is a country-specific role subject to its appointment conditions.

### What happens if I simply do not register?

The commercial consequence usually arrives first. Qualifying marketplaces must verify producer registration for the destination country, so listings can be blocked before an authority acts. National penalties are substantial where they do apply.

### Does this apply to sellers based outside the EU?

Non-EU establishment does not remove packaging EPR responsibilities. Check who is the producer, the direct-to-end-user route and the relevant national requirements. Do not treat a proposal for relief as an adopted exemption.
